Hendershot’s is an authorized NFA (National Firearms Act) Class III dealer. NFA items generally include:
- Suppressors (silencers)
- Machine guns (manufactured before 1986)
- Short-barreled rifles (must meet Maryland’s 29-inch rule)
- Short-barreled shotguns
- AOW’s (any other weapons)
Devices that fit these categories are eligible for purchase and/or transfer in Maryland and are regulated by the Federal Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE). Suppressors are also legal to hunt with in Maryland.
There are two ways to purchase NFA items: individual tax stamp or an NFA Trust.
Individual tax stamp requirements:
- Complete (2) included BATFE Form 4s (5320.4) and sign in blue or black ink
- Obtain (2) passport photos and affix one to each Form 4; do NOT staple
- Make (1) photocopy of your completed Form 4 with passport photo affixed
- Complete (2) FBI Form FD-258s in blue or black ink
- Identify your local Chief Law Enforcement Officer (CLEO)
- Write a $200 check to the BATFE
- The device cannot be loaned to anyone else or stored at any other address. If any other person uses the device, the owner must be present.
NFA trust requirements:
- Complete (2) BATFE Form 4s (5320.4) and sign in blue or black ink
- Make (1) photocopy of your completed Form 4
- Make (1) photocopy of your trust documentation
- Identify ALL responsible persons (including yourself) and per person:
- Complete (1) BATFE Form 5320.23 and sign in blue or black ink for each responsible person
- Obtain and affix to Form 5320.23 (do NOT staple) for each responsible person
- Make (1) photocopy of your completed Form 5320.23, with passport photo affixed, for each responsible person
- Complete (2) FBI Form FD-258s in blue or black ink for each responsible person
- Identify your local Chief Law Enforcement Officer (CLEO)
- Write a $200 check to the BATFE
- You can have several members in the trust, allowing the device(s) to be shared, loaned, and stored at any of the trustee’s addresses.
- If one trustee passes away, the other trustees still retain ownership of the device(s) listed in the trust.

Wait times
Wait times are estimates provided by BATFE. We have no control over the length of time BATFE takes to process applications. Currently, BATFE estimates approximately 8-10 months for approval. Again, this is only an estimate and may very due to circumstances at BATFE.
If we do not have the suppressor in stock that you wish to purchase we are happy to order it for you. All NFA purchases/transfers require full payment in advance. Once your device is on hand and the Form 4 is submitted the estimated 8-10 month wait to transfer the device to you will commence.
If you purchase an NFA item from another dealer, we are happy to handle the transfer for you. Our fee is $75 and must be paid in full before we start your paperwork. Customers who purchase their device from Hendershot’s do not have to pay this transfer fee.
We can only transfer NFA items for residents of Maryland. If you do not live in Maryland and would like to purchase from us, we will assist you in finding an NFA dealer in your state.
Service
At Hendershot’s, we know the paperwork involved with NFA items can be very intimidating. We will walk you through the entire process and explain each step in detail.
- We complete the paperwork for you, explain it to you and have you sign it.
- We FedEx your application packet to the NFA Branch of BATFE in Martinsburg, WV and provide you with the tracking number.
- Once you are approved we call you, give you your tax stamp and your device. It’s that easy!
